As you have purchased from an approved VW Dealership you would not necessarily have to travel 80 miles if there is another Dealership that is nearer. I think the warranty is for 2 years but you may have to check. There is also a 30-day no-quibble exchange policy but would require a Dealer having a suitable vehicle in stock. However, if the vehicle is faulty then you can reject it for a refund within 30 days. If over 30 days you could allow the garage to fix the problem if you want to keep the vehicle but they would only get just the one attempt or you could still reject it. Personally, I would not be happy with a car that pulled sharply to the left under braking as this could be suspension damage.

Iv given the garage a call and they have asked me to bring it back to there garage as most likely this won't be covered under the warrenty if I take it to my local VW. I'm hoping they are able to rectify the problem first time especially as I will be making a 160mile round trip. My worrie is if they turn around and say they can't find anything or try to fob me off with an excuse. When test driving the car i can say I noticed these issues, maybe I wasn't thorough enough and I believed as it was a main dealer they would repair any issues.
If there is a main VW Dealerships closer than 80 miles away then I'm surprised you haven't contacted them about this as any VW dealership will honour the warranty if there is indeed a fault. Do you want to keep this car? Are you within the first 30 days of buying the car? As this is an Approved Used car then you can look to exchange it at any VW dealership. As no car should pull to one side under braking there is clearly an issue but you can indeed allow the dealer to fix the problem if you so wish or of course reject it under your statutory rights.
 
Unfortunately, unless you point out the issues and they agree to fix them, then the car is 'sold as seen'.
Good luck in getting it fixed under the warranty, as in my experience, most items that are likely to need replacement, aren't covered.
Presumably this car came with a new MoT.....?
If this is an Approved Used from VW then within 30 days he can exchange it without giving a reason (obviously he may have to pay more for a more expensive car). With this type of warranty it would not be 'sold as seen' in fact if there is a fault he could either reject it or give the dealer just one chance to rectify it and if not then reject it. I would not be happy if the car pulls to one side under braking.
 
Just to clarify, I meant 'sold as seen' in the sense that, if you notice a problem before sale and ask them to fix it, and they do - then everything else is 'as is'.
Obvioulsly, other faults that might appear later may or may not be covered by warranty. I must say - I'm suprised the car got through the VW Approved Warranty checks with this problem.
I suspect it might be a brake issue- which is why I asked if the car had a new MoT. The brake testing should have revealed any imbalance.
Yes, that's right but without knowing the full circumstances it is difficult to give the right advice.
 
Thanks all for the advice, so under the terms of the approved used I have to take it back to the original garage to be rectified or return for an exchange within 30 days. The care makes a loud creaking noise when coming to a stop similar to when you are braking on an incline and the suspension or brakes creak.
Car was supplied with a fresh 12 month mot with no advisories too. Everything else with the vehicle checks out.

I have also noticed they havnt done a dsg service as they said would be done, cars on 45k miles rather they have only done a haldex service so I am disputing this with the garage too. The car was a good price and tmek me a while to finally get one so ideally I would like them to fix it but if it doesn't get sorted sadly I will be looking to return the car and look elsewhere. Deffinetly been a big learning curve.
Under the terms of the VW's Approved Used scheme you can take your vehicle to any VW Approved Retailer and show your 'Confirmation of Cover' at any time during the period of cover as shown on the document. If you have to make a claim there is a ÂŁ10 excess fee and you would be responsible for costs exceeding ÂŁ750. However, if you are within 30 days then you have statutory rights which would enable you to reject the car if there is a fault - you can allow the garage to fix the problem but you don't have to but you would have to take it back to the same garage for a full refund.

As regards an exchange you can either go back to the same garage or if there is a suitable vehicle at another VW Approved Retailer then you have 30 days to arrange it and pay the difference if applicable.

With any second-hand vehicle even if it is the just the car you want you have to be prepared to walk away - there are always other cars out there.
